2. How We Collect Information
We collect personal information:
- directly from you when you place an order, create an account, start or manage a subscription, contact us, submit a review, sign up for email or SMS marketing, or give us your name and email at an event;
- automatically from your browser or device through cookies, pixels, local storage, server logs, session-replay technology, and similar tools;
- from Shopify and services that support payments, subscriptions, fulfillment, customer support, reviews, analytics, advertising, and marketing;
- from advertising and social-media platforms when they provide campaign or audience information; and
- from partners you choose to use, such as Truemed.
We do not purchase third-party consumer mailing lists.
3. How We Use Personal Information
We may use personal information to:
- process payments, orders, subscriptions, returns, refunds, and exchanges;
- arrange shipping, delivery, and fulfillment;
- create and maintain customer accounts and subscription portals;
- provide customer service and respond to questions;
- send order, subscription, payment, security, and policy notices;
- send email and SMS marketing when we have the required consent;
- send abandoned-cart reminders where permitted;
- personalize products, content, offers, and advertisements;
- measure website, campaign, and business performance;
- detect fraud, protect accounts, secure the website, and prevent misuse;
- maintain records, enforce agreements, and comply with legal, tax, accounting, and regulatory duties;
- investigate or respond to disputes, legal claims, and lawful requests; and
- improve products, services, website design, and customer experience.
We may combine information collected from different sources when permitted by law.
4. Cookies, Pixels, and Analytics
Nutrigazm and its service providers use cookies, pixels, tags, local storage, session-replay tools, and similar technologies. These tools can remember preferences, keep the store and cart working, measure traffic, understand interactions, attribute sales, prevent fraud, personalize content, and support advertising.
The Shopify cookie banner provides available controls in the regions where it is displayed. You can use Manage preferences, Accept, or Decline to make choices. You can also adjust browser settings, but blocking essential technologies may prevent parts of the store from working.
Where required, optional analytics or advertising technologies are used only after the required consent signal. Consent choices may apply only to the browser and device on which they are made.
Nutrigazm currently uses Microsoft Clarity to understand website use through session recordings, heatmaps, interaction measurements, device and browser information, approximate location derived from IP address, and a client identifier cookie. Clarity can obscure certain sensitive fields in recordings, but customers should still avoid entering sensitive information into any field that does not request it. Microsoft describes its data practices in the Microsoft Privacy Statement and Clarity documentation.
The website may respond to legally recognized universal opt-out signals, such as Global Privacy Control, when required and technically supported. A browser “Do Not Track” setting is not necessarily the same as a legally recognized opt-out signal.
5. Marketing Communications
Nutrigazm uses Klaviyo to send marketing email, SMS messages, abandoned-cart messages, and related communications. We may use your contact information, purchase history, browsing activity, preferences, and engagement with previous messages to tailor these communications where permitted.
You can unsubscribe from marketing emails using the link in the message. You can opt out of marketing texts by replying STOP or using another method described in the message. We may retain a suppression record so that we can honor the request.
Opting out of marketing does not stop transactional or service messages about orders, subscriptions, payments, accounts, security, or policy changes.
For Canadian recipients, Nutrigazm will send commercial electronic messages only with the consent or other legal basis required by Canada's Anti-Spam Legislation and will include sender identification and an unsubscribe mechanism.
6. Services and Third Parties
We may disclose personal information to service providers and other parties that support the purposes described in this policy. The categories and representative services currently include:
- Commerce, hosting, checkout, payments, and fraud prevention: Shopify, Shopify Payments, Shop Pay, Apple Pay, and Google Pay.
- Subscriptions: Appstle Subscriptions, which receives information needed to create and manage recurring orders and customer notices. Appstle states that billing information remains in Shopify's checkout system.
- Email, SMS, and customer-data tools: Klaviyo.
- Reviews and customer feedback: Judge.me and Klaviyo Reviews.
- Store personalization and conversion tools: Rebuy Personalization Engine and One Click Upsell.
- Analytics and advertising: Meta and Facebook/Instagram, Google and YouTube, TikTok, Triple Whale, and Microsoft Clarity.
- Website and campaign tools: Replo, Shogun, and UpPromote.
- Specialized purchase eligibility: Truemed.
- Shipping and fulfillment: UPS and Nutrigazm's contracted fulfillment providers.
- Professional and legal support: accountants, lawyers, insurers, auditors, security providers, and other advisers when reasonably necessary.
We may also disclose information:
- to comply with law, legal process, court orders, or lawful government requests;
- to protect customers, Nutrigazm, service providers, or the public;
- to investigate fraud, security incidents, or violations of our agreements; or
- in connection with a merger, financing, sale, reorganization, or transfer of all or part of the business, subject to applicable law.
Service providers can change as Nutrigazm's operations change. We will update this policy when a material change requires notice or consent.
7. Truemed and Health-Related Information
Truemed is a separate telehealth and payments company that helps qualified customers use HSA or FSA funds for eligible purchases. If you choose Truemed, it may collect health-related information directly through its qualification process and may involve independent medical groups or providers.
Nutrigazm does not ask you to submit Truemed qualification answers through Nutrigazm store forms. Depending on the transaction and integration, Nutrigazm may receive confirmation or transaction information needed to complete or support the purchase.
Information submitted directly to Truemed is governed by Truemed's Privacy Policy, its Consumer Health Data Privacy Policy, and any applicable medical group's notice. Do not send health information to Nutrigazm by email unless it is necessary for your request.
8. Targeted Advertising, Sale, and Sharing
Nutrigazm does not sell or rent customer lists for money. We use advertising and measurement services, including Meta, Google, TikTok, and Triple Whale. We also have connected tools from Shogun and other store services. Those technologies may disclose identifiers, device information, online activity, commercial information, approximate location, and inferences to advertising or analytics partners.
Some United States state laws define these disclosures as a “sale,” “sharing,” or “targeted advertising,” even when no money is exchanged for personal information. Where those laws apply, you may opt out using the Data Sharing Opt-Out Page linked in the store footer when available, by sending a recognized universal opt-out signal, or by emailing hello@nutrigazm.com for help.
Nutrigazm does not knowingly sell or share personal information of anyone under 18.
9. Your Privacy Rights and Choices
Depending on where you live and subject to legal exceptions, you may have the right to:
- request access to personal information we hold about you;
- request correction of inaccurate personal information;
- request deletion of personal information;
- receive a portable copy of certain personal information;
- withdraw consent where processing depends on consent;
- opt out of sale, sharing, or targeted advertising;
- limit certain uses of sensitive personal information where applicable;
- appeal a decision about a privacy request where applicable; and
- receive equal service and pricing without discrimination for exercising a privacy right.
To submit a request, email hello@nutrigazm.com and describe the right you want to exercise. We may ask for information needed to verify your identity and protect your account. An authorized agent may submit a request where applicable law permits, but we may require proof of authorization and direct verification with you.
We will respond within the time required by applicable law. We may deny or limit a request when an exception applies, such as when information must be retained for a transaction, legal duty, security purpose, fraud prevention, or legal claim. If applicable law gives you a right to appeal our decision, reply to our response and state that you are appealing.
Canadian customers may also ask how their personal information has been used or disclosed, request access or correction, withdraw consent subject to legal or contractual limits, or raise a privacy complaint. If a concern is not resolved, you may contact the Office of the Privacy Commissioner of Canada or the applicable provincial privacy regulator.
Shopify also processes information when you interact with a Shopify-powered store. You can learn about Shopify's processing and exercise rights directly with Shopify through the Shopify Consumer Privacy Policy.
10. Data Retention
We retain personal information only as long as reasonably necessary for the purposes described in this policy, including to provide products and services, maintain accounts and subscriptions, honor marketing choices, comply with tax and accounting duties, prevent fraud, resolve disputes, enforce agreements, and meet legal requirements.
The criteria used to determine a retention period include:
- the length of the customer or account relationship;
- the time needed to complete a transaction or provide support;
- legal, tax, accounting, reporting, and recordkeeping requirements;
- applicable limitation periods and the need to establish or defend legal claims;
- fraud-prevention, security, backup, and business-continuity needs;
- customer deletion or withdrawal requests; and
- the retention settings and contractual terms of the service providers involved.
Marketing contact information is retained until you unsubscribe, withdraw consent, or we no longer need it, subject to maintaining a suppression record. Some information may remain in backups for a limited period or be retained in de-identified form.
11. Security
We use administrative, technical, and physical safeguards designed to protect personal information. No online system, transmission method, or storage technology is completely secure, so we cannot guarantee absolute security.
You are responsible for protecting your account credentials and for contacting us if you suspect unauthorized activity.
12. International Processing
Nutrigazm is based in the United States. Shopify and other service providers may process personal information in the United States, Canada, and other countries where they or their service providers operate. Privacy laws in those countries may differ from the laws where you live, and information may be accessible to courts, law enforcement, or regulatory authorities as legally required.
Where required, Nutrigazm and its providers use appropriate contractual or legal safeguards for international transfers.
13. Children
The website is not directed to children. You must be at least 18 years old or the age of majority where you live, whichever is higher, to create an account or place an order.
We do not knowingly collect personal information from anyone under 18 for the purpose of selling or marketing Nutrigazm products. If you believe a minor has provided personal information, contact hello@nutrigazm.com.
14. Automated Tools
Nutrigazm and its service providers may use automated tools for fraud prevention, security, order processing, personalization, and advertising. Nutrigazm does not intend to use solely automated processing to make decisions that produce legal or similarly significant effects about a customer without appropriate review, except as applicable law permits.
15. Changes to This Policy
We may update this policy to reflect changes in law, technology, service providers, or business practices. The “Last updated” date identifies the current version. When required, we will provide additional notice or request consent before a material change takes effect.
