These Terms of Service govern your use of nutrigazm.com and your purchases from Nutrigazm. In these Terms, “Nutrigazm,” “we,” “us,” and “our” mean Nutrigazm LLC, doing business as Nutrigazm.
By accessing the website, creating an account, placing an order, or using a service offered through the website, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the website or place an order.
1. Eligibility and Accounts
You must be at least 18 years old or the age of majority where you live, whichever is higher, to create an account or place an order.
You are responsible for providing accurate, current, and complete information and for maintaining the security of your account credentials. Notify us promptly at hello@nutrigazm.com if you believe your account has been used without authorization.
2. Products and Information
We work to present product descriptions, images, ingredients, nutrition information, prices, and availability accurately. Packaging, appearance, and other details may change, and screen settings can affect how colors appear.
Always read the product label before use. If you have an allergy, medical condition, take medication, are pregnant or nursing, or have questions about whether a product is appropriate for you, consult a qualified healthcare professional before use.
The website provides general educational and product information. It is not medical advice, diagnosis, or treatment. Statements about Nutrigazm products have not necessarily been evaluated by the United States Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent disease.
3. Orders, Prices, and Payment
Submitting an order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons, including product availability, suspected fraud, pricing or description errors, payment problems, shipping restrictions, or violation of these Terms.
Prices and available currencies may vary by market. Taxes and shipping charges are shown when applicable. Customers receiving an order outside the United States are responsible for import duties, taxes, brokerage fees, and related charges that are not collected at checkout.
Payment is processed through Shopify and the payment methods made available at checkout, which may include Shopify Payments, Shop Pay, Apple Pay, and Google Pay. We do not receive your complete payment-card number from those payment providers.
If we cancel a paid order before fulfillment, we will issue an appropriate refund to the original payment method.
4. Shipping and Delivery
Shipping availability, processing times, rates, delivery estimates, address responsibilities, and lost-package procedures are described in the Nutrigazm Shipping Policy, which is incorporated into these Terms.
Delivery dates are estimates unless applicable law states otherwise. Risk of loss and legal title pass as provided by applicable law and the carrier arrangement.
5. Returns, Refunds, and Exchanges
Returns, refunds, exchanges, and the 30-day satisfaction guarantee are governed by the Nutrigazm Refund Policy, which is incorporated into these Terms.
Nothing in these Terms limits a non-waivable right or remedy available under applicable consumer-protection law.
6. Subscriptions
When you choose a subscription, you authorize recurring charges according to the product, price, discount, frequency, shipping, tax, and cancellation terms presented before enrollment.
Subscriptions continue until cancelled. You may cancel through the online subscription portal before the next renewal charge is processed. Cancellation applies to future unprocessed renewals and does not automatically cancel or refund an order that has already been charged.

7. Promotions, Discounts, and Gift Cards
Promotions and discounts are subject to the terms presented with the offer. Unless an offer states otherwise, promotions cannot be combined, have no cash value, and may be modified or ended as permitted by law.
Gift cards are subject to applicable law and any terms shown when purchased or redeemed.
8. Acceptable Use
You may use the website only for lawful personal or business purposes consistent with these Terms. You must not:
- use the website for fraud, unlawful activity, or infringement of another person's rights;
- interfere with the website's security, operation, or availability;
- introduce malware or harmful code;
- scrape, copy, harvest, or extract website content or customer information through automated means without written permission;
- impersonate another person or misrepresent your identity;
- attempt unauthorized access to an account, system, or network; or
- use the website in a way that places an unreasonable burden on its infrastructure.
We may suspend or terminate access when reasonably necessary to protect Nutrigazm, customers, service providers, or the public.
9. Intellectual Property
The website and its content, including text, graphics, logos, product names, photographs, videos, designs, and software, are owned by or licensed to Nutrigazm and protected by intellectual-property laws.
You may access and use the website for personal, non-commercial shopping and information. No other license is granted. You may not reproduce, distribute, modify, publicly display, sell, or commercially exploit protected content without written permission from the rights holder.
10. Reviews, Messages, and Submitted Content
If you submit a review, comment, photograph, message, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person's rights.
You grant Nutrigazm a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content for operating, improving, and promoting Nutrigazm, subject to applicable law and our Privacy Policy. This license ends when the content is deleted where the nature of the use and applicable law allow.
We may moderate or remove submitted content that violates these Terms, but we are not required to monitor every submission.
11. Third-Party Services and Links
The website uses third-party services for commerce, payments, subscriptions, reviews, analytics, marketing, fulfillment, and other operations. It may also link to websites that Nutrigazm does not control.
Third-party services may have their own terms and privacy practices. Nutrigazm is not responsible for an independent third party's content, products, security, or conduct, except to the extent responsibility cannot legally be excluded.
12. Privacy
Our collection, use, and disclosure of personal information are described in the Nutrigazm Privacy Policy. Shopify also processes information when you interact with a Shopify-powered store, as described in the Shopify Consumer Privacy Policy.
13. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. Nutrigazm does not guarantee that the website will always be uninterrupted, error-free, secure, or compatible with every device.
Products are subject to the express promises in their descriptions, the Refund Policy, and applicable law. Nothing in this section excludes an express warranty or a non-waivable statutory warranty.
14. Limitation of Liability
To the fullest extent permitted by law, Nutrigazm and its officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the website, a product, or these Terms.
Where liability cannot be excluded, Nutrigazm's total liability for a claim will not exceed the greater of the amount you paid Nutrigazm for the product or service giving rise to the claim or USD $100.
These limits do not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence, violation of a non-waivable consumer right, or any liability that applicable law does not allow us to limit.
15. Indemnification
To the extent permitted by law, you agree to reimburse Nutrigazm for reasonable losses, liabilities, and expenses arising from your intentional misuse of the website, your unlawful conduct, or content you submit in violation of these Terms. This section does not require you to reimburse Nutrigazm for its own negligence or wrongdoing.
16. Changes to the Website and These Terms
We may update the website, product offerings, and these Terms. The “Last updated” date identifies the current version. When applicable law requires advance notice or renewed consent, we will provide it.
Changes apply prospectively from their effective date. Continuing to use the website after an update takes effect means you accept the updated Terms, except where the law requires another form of consent.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection right to bring a claim elsewhere, disputes relating to these Terms or a purchase from Nutrigazm will be brought in the state or federal courts serving Mono County, California, and the parties consent to those courts' jurisdiction.
Nothing in these Terms deprives a consumer of mandatory protections available under the law of the place where the consumer resides.
18. General Terms
If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect and the affected provision will be enforced to the maximum extent permitted by law.
Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. Nutrigazm may assign them as part of a merger, reorganization, asset transfer, or other lawful business transaction.
These Terms and the policies incorporated into them form the entire agreement concerning the website and purchases, except for any additional terms expressly presented for a particular offer or service.
